[The following is a Letter to the Editor]
I am looking to hire an election’s attorney to represent me at the upcoming hearing on July 18, 2014 in Waukegan, IL at 9:30am.
Having reviewed case law on the objections that were withdrawn at last week’s hearing, I want to argue that the objector’s petition qualifies as “shotgunning” and motion to dismiss the entire objection petition since the objections were not grounded in fact and no effort to conduct a reasonable investigation prior to filing the objection was made.
Facts of the case:
1. of the 82 signature objections on petition sheets 1-50 only 10 were sustained. That’s around 12%. Clearly the objector did not investigate to see if her objections were factual considering nearly 90% of the signatures she tried to invalidate, were in fact valid. The frivolous attack on voter signatures is in violation of state law.
2. the objector further alleges that 69 petition sheets are photocopies, yet her expert forensic analyst never assessed the quality of the original sheets until after the start of the hearing. She cannot sign under oath that she investigated the objections that she filed against me under the claim that she did so in fact and according to law, when clearly her investigation into the photocopy allegation did not occur until 11 days after she filed the objection. An investigation does not occur at the time of the hearing, an investigation is required to be performed in order to establish a cause of action which is the purpose of the hearing—to present evidence: not create it!
3. my petition packet met every single requirement under law. The State Board of Election pictures of my Nominating papers show that I complied 100% with the law and all its requirements. Not one requirement was ignored.
